III Purposes and legal bases of data processing
When you use our website, we process personal data exclusively for specified purposes, which we explain in detail below for your information.
You can visit our website purely for information purposes without actively providing any further personal data. In this case, only technical access data transmitted by your browser will be automatically stored about your visit to our website in order to enable you to visit our website in an optimized and needs-based manner and to protect our systems from security risks (accessing/visiting the website, technical provision) as well as information that is transmitted to us within the framework of cookies used for statistical analysis of the use of our website and for the interest-based display of advertisements (use of cookies).

Access and Visit of Our Website For the purpose of technically providing the website, it is necessary for us to process certain automatically transmitted information from you so that your browser can display our website and you can use the website.     The EU General Data Protection Regulation (GDPR), which comes into force on May 25, 2018, is a regulation of the European Union that creates a directly applicable legal basis for the processing of personal data by authorities and companies across Europe. With this, the European Union aims to extend the protection of personal data and thus strengthen the individual in terms of their right to informational self-determination. PORTEGO GmbH takes the protection of personal data very seriously. We process your personal data in compliance with the legal provisions for data protection, in particular the provisions of the GDPR and the Federal Data Protection Act (BDSG). With the following information, we fulfill our legal obligation to inform you according to Art. 12 ff. GDPR about the purpose and relevant contacts in data processing and enable you to exercise your legal rights in data processing.

    PORTEGO GmbH provides needs-based and flexible staffing solutions through the provision and placement of specialist and executive staff. This includes the placement of staff for direct employment by our clients (recruitment), the provision of staff as part of temporary/agency work (temporary employment), and the provision of interim and project managers (hereinafter referred to as "our Personnel Services").


This information sheet is directed at candidates and applicants who apply for open positions in the area of our Personnel Services or on their own initiative, who are suitable for corresponding positions, or who are deployed in this context (hereinafter collectively referred to as "Applicants"). Separate data protection information applies to employees employed in the PORTEGO’s own business operations and applicants thereof, as well as to visitors of our websites and our events (see our General Data Protection Information).

5. Purposes of Processing and Legal Bases
a) Contract Initiation and Fulfillment
In the field of our staffing services, we process your personal data as an applicant for the purpose of providing these staffing services and for the establishment of related contractual relationships between you and PORTEGO or our clients, as well as, in the case of a corresponding hiring or commissioning, for the execution and possibly termination of related contractual relationships (especially in the context of specialized personnel placement/staff leasing and the deployment as interim/project managers).
The data processed by PORTEGO concerning you includes, among others, your basic data (name, address, date of birth, etc.), your application documents (CV, certificates, and application photo) including corresponding information shared about you and your qualifications (especially education, professional career, knowledge and skills), as well as possibly further application-relevant data (e.g., your preferred areas of deployment and activity, salary expectations, work permit, etc.). Moreover, it may be necessary for PORTEGO, as part of the contractual duty to carefully select suitable candidates for its clients, to require a police clearance certificate from you, which is stored exclusively with your consent. The aforementioned data is processed in order to assess your suitability for the position to be filled and to be able to offer you further employment positions tailored to your person and qualifications, if applicable.

In the case of your placement within the scope of specialized personnel placement/staff leasing or as an interim/project manager, PORTEGO also processes the data necessary for the transfer to clients, such as the proof of activity, your absences due to illness or vacation, as well as your social security and tax data necessary for payroll accounting for the purpose of executing the corresponding contractual relationship. Furthermore, we store the evaluation of your work performance communicated by our clients (customer feedback). The data processing by the clients themselves is the responsibility of the clients; for information in this regard, please contact the respective client where you are deployed in the context of specialized personnel placement/staff leasing or as an interim/project manager.
It is possible that the data you provided during the application process or otherwise collected may include special categories of personal data. These may include, for example, religious or philosophical beliefs, the presence of a disability, or other health-related information. Processing of special categories of personal data only takes place if this is legally required, such as in the case of absence times and sickness reports for claiming benefits from health insurance, tax-relevant data on church memberships, and data collected in connection with the suspicion of criminal activities.

We primarily process data within the respective application/staffing processes that you have provided to us. In addition, for the aforementioned purposes, we may also receive data from the following additional sources:

- Previous employers, provided you have consented to us contacting them as part of your application process;
- Clients, provided you have been deployed by them in the context of specialized personnel placement/staff leasing or as an interim/project manager.

 

The legal basis for the aforementioned processing of your data results from Art. 6 Para. 1 S. 1 lit. b GDPR, Art. 9 Para. 2 lit. b, Art. 88 GDPR, § 26 Para. 1 S. 1, Para. 3 BDSG.

 

b) Consent (Career Support)

PORTEGO, as a specialized personnel service provider, offers candidates a lasting professional partnership and career support. As part of this ongoing professional partnership, PORTEGO will use your personal data (especially your email address and phone number) beyond the specific application process and any potential temporary assignments of your services within the framework of specialized personnel placement/temporary employment or as an interim/project manager, to stay in regular contact with you and to accompany you on your further career path, provided that you give us your consent to do so. Naturally, you can revoke the consent you have given at any time for the future.

The legal basis for the processing of your data in the context of career support is derived from Art. 6 para. 1 sentence 1 lit. a GDPR, Art. 88 GDPR, § 26 para. 2 BDSG.

c) Additional Processing Purposes and Legal Bases

Where necessary, we process data concerning you for the following purposes, based on legal grounds, particularly in the context of temporary employment and when working as an interim manager:

Investigation of criminal offences: when there are factual indications that give rise to the suspicion that a criminal offence has been committed within the employment relationship and the processing is necessary for the investigation and your legitimate interests in the exclusion of processing do not prevail (Art. 88 GDPR, § 26 para. 1 sentence 2 BDSG); and

Fulfillment of legal obligations: in the form of record-keeping, reporting, and notification obligations, processing of requests from law enforcement authorities or other agencies, and the defence against or enforcement of legal claims (Art. 6 para. 1 lit. c) GDPR).

To the extent that data processing for the following purposes is not already necessary for the performance of the respective contractual relationship, we also process data on a legal basis due to a legitimate interest (Art. 6 para. 1 lit. f) GDPR) or consent for the following purposes:

Maintenance of business operations and ensuring compliance, such as the operation, management, and enabling the use of information technology and communication systems, information exchange in the intranet/extranet, protection of trade and business secrets and company property including IT infrastructure from loss and threats such as viruses, spam, and other attacks and threat scenarios, project management, ensuring business continuity, creation of audit trails and other reporting tools, budgeting, financial management and reporting, other internal administrative purposes within the corporate group, management of corporate mergers and acquisitions as well as reorganizations and sales, preventive measures to prevent criminal behavior and administrative offenses or the violation of company regulations. In this regard, we have carefully reviewed your need for protection in relation to the processing of these data. In the case of data processing that is based on a balance of interests, you are generally entitled to object. However, in this case, we reserve the right to continue processing if, after re-examination, we conclude that our legitimate interest in processing these data outweighs your interests or fundamental rights and freedoms. (Please also consider your rights as a data subject outlined under section 10 of this Data Protection Information.)

6. Recipients
Initially, only our employees who are involved with the care of applicants in personnel, sales, or technical matters will have knowledge of your personal data.

Furthermore, your basic data, application documents, and a candidate profile developed from this about you may be transmitted to our clients to present you as a candidate, as part of providing our personnel services. This transmission is exclusively to clients who desire a collaboration based on your qualification and interest profile.

PORTEGO carries out its core activities without the support of other external service providers. However, some of our clients occasionally wish to involve additional service providers who support in selecting suitable candidates or in processing orders. With these service providers, we conclude data protection agreements to contractually establish an appropriate handling of personal data.

Moreover, we transmit personal data, particularly from you as an employee in the area of temporary employment, to entities that require this information to fulfill their respective tasks. These are in particular: public bodies such as social insurance agencies, the German Pension Insurance, professional associations, health insurance companies, and the tax office, in order to comply with our social security and tax obligations, among other things.

Finally, in individual cases, we transmit personal data to our consultants in legal or tax matters, whereby these recipients are obligated to special confidentiality and secrecy due to their professional legal status.
 

7. Duration of Storage and Deletion of Your Personal Data
PORTEGO stores your personal data for the duration of the initiation and the duration of the contractual relationship, as long as it is necessary for the justification and/or execution of the respective contractual relationship.

If you apply for a specific position in the area of personnel placement with us, we will delete your data after three months following a rejection or successful placement with our client, unless you have consented to further storage within the framework of career support.

In the case of your employment in the context of temporary work or as an interim/project manager, your personal data will be deleted by us when the contractual relationship between you and PORTEGO has ended, all mutual claims have been fulfilled, and there are no legal retention obligations, for example from the Commercial Code (§§ 238, 257 paragraph 4 HGB) or from the Tax Code (§ 147 paragraph 3, 4 AO), or other legal bases for storage (e.g., your consent to further storage within the framework of career support, see above) no longer exist.

8. Data Security
Personal data is protected by PORTEGO using appropriate technical and organizational measures to ensure an adequate level of protection and to safeguard the personal rights of applicants. The measures taken serve, among other things, to prevent unauthorized access to the technical facilities used by us and to protect personal data from unauthorized knowledge by third parties.

9. Obligation to Provide Your Data
The provision of some personal data that you provide to us as an applicant is legally or contractually required or necessary for the establishment or proper execution of the corresponding contractual relationships. Therefore, you are obligated to provide us with this personal data. We point out that if you do not provide us with this personal data, it may result in us not being able to consider you in the respective application procedures or not being able to fulfill certain contractual obligations.

10. Your Rights as a Data Subject
a) Information, Correction, Deletion, etc.
Upon request, you will receive information as to whether and which personal data concerning you are stored by us and, among other things, to which categories of recipients we have possibly transmitted this data. Furthermore, in accordance with legal provisions, you can exercise the following rights: correction, deletion, restriction of processing (blocking for certain purposes), and the right to data portability.

b) Right to Object (including against direct marketing)
You have the right, under the conditions of Article 21 of the GDPR, to object to the processing of your personal data, especially on the basis of a balancing of interests (Article 6(1)(f) GDPR). This also applies to cases where we process your personal data in individual cases for direct marketing purposes. In this respect, we balance our interest in addressing you for advertising purposes with your right to informational self-determination. If you do not want to receive advertising from PORTEGO, you may object at any time to the processing for advertising purposes.

1. You have the right to object at any time to the processing of your data which takes place on the basis of Article 6 (1) (f) GDPR (data processing on the basis of a balance of interests), if there are reasons arising from your particular situation.

If you lodge an objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or for the establishment, exercise, or defense of legal claims.

Right of Access: At any time, you have the right, under Art. 15 GDPR, to request confirmation from us as to whether we are processing personal data concerning you; if this is the case, under Art. 15 GDPR, you also have the right to be informed about this personal data and certain other information (including the purposes of the processing, categories of personal data, categories of recipients, planned duration of storage, the source of the data, the use of automated decision-making, and in the case of third-country transfers the appropriate safeguards) and to receive a copy of your data. Right to Data Portability: You have the right, under the conditions of Art. 20 GDPR, to demand that we provide you with the personal data concerning you which you have provided to us, in a structured, commonly used and machine-readable format.

Right to Withdraw Consent: You have the right to withdraw your consent to the processing of personal data at any time with effect for the future.

Right to Object: You have the right, under the conditions of Art. 21 GDPR, to object to the processing of your personal data, so we must stop processing your personal data. The right to object exists only within the limits provided in Art. 21 GDPR. Moreover, our interests may oppose the termination of processing, so we may be entitled to process your personal data despite your objection.

VII. Scope of Your Obligations to Provide Data
In principle, you are not obliged to provide us with your personal data. However, if you do not do so, we will not be able to provide you with our contractual services or respond to your inquiries. Likewise, we will not be able to avail ourselves of your contractual services. Personal data that are not strictly necessary for the above-mentioned processing purposes are accordingly marked as voluntary information.
